    1. Materiality v. non-materiality.

 

  1. What is a procedural fairness letter.
    1. When does an Applicant have a right to a procedural fairness letter.
    2. How does an applicant reply to a procedural fairness letter.

i.      What does an applicant include?

  1. What are the consequences if an Applicant is determined to have misrepresented themselves in an immigration application.
    1. Refusal, Possible Exclusion Order and Ban from Canada for Five Years.
  2. What can be done by a representative to resolve the consequences of a finding of misrepresentation.
    1. Reconsideration.
    2. Federal Court.
    3. New Application / Authorization to Return to Canada.

 

  1. Ethics and Professionalism:
    1. What do you do if you suspect there is a misrepresentation.
    2. How do you ensure that you do not participate in a misrepresentation.
    3. How can you best manage the file to avoid a misrepresentation.
