Service/Retainer agreements and new Ethics codes

This webinar will breakdown the retainer/client relation updates in the new ethics codes published in June 2022. We will also cover basic contract law which is applicable to any services.

  1. Overall changes- Retainer Agreement renamed to Service Agreement
  2. Background of contracts and promise, valid offer and acceptance
    • Who has jurisdiction, provincial small claim courts or CICC disciplinary committee?
  3. Initial consultation, opinion to be provided-- Section 23 to 27
    • Written initial consultation agreements are mandatory in new codes
    • What to do with no hope no merits cases? – new codes
  4. Mandatory service agreement components and termination; Section 28 to 36
    • Dedicated retainer explanation meeting
    • Scope of services and Expectation of clients
    • Early termination and dispute resolution
    • Hourly or Milestone or Flat Fee charges
    • Fair and reasonable charges
  5. Conflicts of interest, employment or student recruitment; Section 15 to 18 new code
    • Ban to provide both services simultaneously
    • Exceptions
  6. Professional Conduct general standards, loyalty, honesty and candour; and anti-discrimination - Section 5 to 14
  7. Marketing of Services – Section 44 to 46
  8. Relationship with staff, agent and fellow RCICs.
