REHABILITATION and DEEMED REHABILITATION

Applicants who might be considered criminally inadmissible to Canada may be able to overcome the inadmissibility under IRPA, if they qualify for Rehabilitation or Deemed Rehabilitation. This seminar will address the following topics:

- key court decisions (i.e. Tran);
- recent changes to the Criminal Code - after December 17th anyone with a DUI will need Rehabilitation in order to be granted admission/PR to Canada;
- understanding sentencing provisions;
- how to read FBI and police reports;
- the art of determining equivalency;
- what should be included in an application for Rehab or Deemed Rehab;
- successfully managing ethical issues pertaining to clients, especially in light of the employee-employer relationship (the company hired you and the employee has an undisclosed criminal record...)
