Part 1: Where to begin? H&C: Yes or no?
Legal basis of H&C
· A25
· Eligibility, admissibility, exclusion
Initial consultation: Always paid – fixed rate (preferably recorded after signing the ICA – privacy concerns)
· Introducing the Initial Consultation Agreement
· Collecting the fee
· Opening a case
· Verifying client’s identity (taking copies of passport or personal ID accepted in Canada)
· Asking the right questions, digging for information, assessing the merits of the case
· Follow-up questions, gaining a deep insight into the client’s motivations, agenda, assessing the credibility
· Request for supporting documentation
· Request for a meeting with family members
Managing the client:
· If the case shows merits:
o Explaining the principles of H&C, burden of proof, credibility
o Risks vs. benefits
o Approximate cost of representation
o Approximate cost of medical exams, translations, affidavits, obtaining additional documents, etc.
o Recommended next steps based on the assessment
o Introducing the Retainer Agreement
· If the case does not show merits:
o Explaining the principles of H&C, burden of proof, credibility
o Risks of going forward, consequences of misrepresentation
o Noting the reasons for not accepting the case in writing
o Client signs the notes and keeps a copy of the case notes
Exercise
Introducing a client with basic information. Attendees will ask their own questions to gather information before deciding whether to accept the client or not.
Questions and answers will be noted on a whiteboard for all to see
