LMIA applications: Lessons learned and suggestions 

LMIA applications

• Explore options for LMIA-exempt categories (if applicable)
• Cases where “you can’t avoid the unavoidable” (LMIA is a must)
• Educate employer; explain employer’s role and involvement in the LMIA process; government processing fees & job advertisement costs

Preparation:

• Assess position / job duties; position level within company; education, work experience and skills requirements for the position; foreign worker’s qualifications; employer’s needs
• Assess NOC code; hourly wage
• Understand company’s business
• Assess skills / work experience requirements which are unique and uncommon (if applicable)
• Understand why certain skills / work experience are required, and why a combination of skills / work experience is required
• Establish list of education / skills and work experience required for the position
• Understand how to “position” the LMIA application
• Prepare draft job posting
• Assess and ensure compliance with advertising requirements
• Assess eligibility for any exemptions (such as advertising exemption; transition plan exemption)
• Post job posting

Draft application forms and documents

• Obtain company data/info from employer
• Evaluate results of advertising efforts
• Assess applicants’ qualifications against job requirements
• Prepare charts to explain advertising results

LMIA processing

• Role: to assist Service Canada officers in understanding the LMIA application
• Officer’s requests for additional information / documents
